1. Definitions

Knight Vizion 360: means Markita Knight dba  Knight Vizion LLC and any employees.

client: means the person, organisation, company or other body which is hiring the goods as specified on the Booking Form.

event: means the booking period and any set up or pack down time required in and around the booking period as outlined on the Booking Form.

event date: means the time and date of the event, confirmed by Knight Vizion LLC and noted on the Booking Form.

booking form: means the online form completed by, or on behalf of, the client and Knight Vizion specifying details of the booking.

day: means a calendar day, unless specified otherwise.

2. Booking Confirmation 

2.1. A booking is not confirmed until the client returns a booking form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Knight Vizion.

2.2. The booking details outlined in the booking form are deemed to be confirmed once the contract is signed. Changes after this time are not guaranteed and subject to availability.

2.3. Travel Fees may apply to events outside of the Los Angeles, CA metro areas at the complete discretion of Knight Vizion LLC. These fees may be added after a confirmed booking of the venue location is not disclosed at the time of booking as being outside of the Los Angeles, CA metropolitan areas.

3. Payments

3.1. A non-refundable deposit of $75 of the retail price of the booking cost is payable upon booking. The booking is not confirmed until the deposit is received by Knight Vizion LLC, and the dates requested.

3.2. The balance of the total booking cost is payable 7-14 days prior to the Client’s Event Date.

3.3. If the balance of the booking cost and the bond are not received more than 7-14 days before the event date, the booking will be cancelled, and the client will forfeit the deposit and event date.

4. Event Delivery Requirements

4.1. The Client must ensure a safe and appropriate environment is provided for Knight VIzion to operate its equipment.

4.2. The Client must provide adequate time for Knight Vizion equipment to be set up, this is a minimum of one hour for all equipment except Green Screen and 360 photo Booths which require two hours.

4.3. The client must ensure: a space of 3m x 3m or more, access to 240v power within 10m of Knight Vizion LLC’ equipment, all doorways and access paths are at least 80cm wide.

4.4. The Client must provide adequate and reliable Wi-Fi connection for access to digital photo delivery or sharing.

4.5. If the event is outdoors an undercover area must be provided as well as shelter from wind, moisture and direct sunlight.

4.6. A site visit of the event location may be required if Knight Vizion LLC is not satisfied that a suitable location will be provided. This site visit may incur an additional fee to recoup costs. These costs may include, but are not limited to, parking, electricity and internet connection.

4.7. The Client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include, but are not limited to, parking, electricity and internet connection.

5. Changes & Cancellations

5.1. Requests for changes of the event date must be made at least 15 days before the original event date. A date change is subject to availability and receipt of a new Booking Form.

5.2. If the client requests use of Knight Vizion LLC' services in excess of the time noted on the booking form, this will be billed at $150 for each additional hour or part-hour on a pro rata basis.

5.3. All cancellations will result in the client forfeiting the deposit, however if Knight Vizion LLC is notified of cancellation more than 30 days before the event date, credit to the value of the deposit will be given to the client to use for any future booking made within six months of the date of cancellation.

5.4. Cancellations made within 30 days of the event date will result in the client forfeiting all payments made to Knight Vizion LLC, with the exception of the bond which will be returned to the client within five business days after the date of cancellation.

5.5. Knight Vizion LLC can cancel any booking at any time. If Knight Vizion LLC decides to cancel a booking, upon discretion amounts paid may be refunded.

5.6. If an event is cancelled as a direct result of state or federal government regulations relating directly to COVID-19, a full refund will be offered. To be eligible for a full refund, Knight Vizion LLC require cancellation in writing more than 48 hours before start time of the event.

5.7. If the event is cancelled in writing, less than 48 hours from event start time, Knight Vizion LLC will offer credit only for 100% of the booking fee and allow the client to use this credit for a new date within a twelve month period.

6. Damage To Equipment

6.1. In order to prevent damage to equipment, Knight Vizion LLC reserves the right to deny service to any person.

6.2. If circumstances arise where a threat or implied threat of harm, damage or violence to Knight Vizion LLC’ staff or equipment, Knight Vizion LLC reserves the right to cease providing services. If the client is able to resolve the threatening situation within 20 minutes, Knight Vizion LLC will resume services. If the situation is unable to be resolved, Knight Vizion LLC will not resume providing service and the client will receive no refund of booking cost.

6.3. The Client is liable for any damage or theft to Knight Vizion LLC equipment during the client’s event whether caused by the client, client’s guests or any other person in attendance at the event whether invited or not. Should such damage or theft occur, the cost to repair/replace the equipment will be charged to the client to be paid within 30 days of the event.

7. Use Of Images 

7.1. The client gives permission for all photographs taken during the event to be used on Knight Vizion LLC website and other promotional material.

8. Indemnification

8.1. Knight Vizion LLC will not be held responsible for any circumstances outside their control. This includes, but is not limited to, fire, riot, civil commotion, accidents, acts of nature and equipment failure. If such circumstances arise, all reasonable efforts will be made by Knight Vizion LLC to provide service or find a suitable replacement service. If this is not possible, the client will receive a refund of all payments received by Knight Vizion LLC for the booking, minus deposits paid.

8.2. The client agrees that in all circumstances, Knight Vizion LLC  liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.
